On April 24, 1957 Hardware Mutual Casualty Company and Joseph Huber brought action against Harry Crow & Son, Inc. and New Amsterdam Casualty Company to recover damages for personal injuries sustained by Huber on July 16, 1955. Hardware Mutual Casualty Company was the compensation insurer of Huber's employer and New Amsterdam Casualty Company was the liability insurer of a truck owned by Harry Crow & Son, Inc. and operated by its employee, Ralph Orr. The jury found Huber causally negligent with respect to lookout; found Orr causally negligent with respect to management and control; attributed 85% of the causal negligence to Orr and 15% to Huber and awarded $4,000 as Huber's loss of earnings to the date of trial and $7,500 for personal injuries. On April 10, 1958 judgment in favor of plaintiffs was entered upon the verdict and defendants appealed.
